MonarchCare is ready to assist family and private guardians to complete reports mandated by the Court system. Further, MonarchCare can assist with your duties as guardian and provide expert witness testimony at hearings or trials. Lastly, MonarchCare can be appointed as a guardian of the person and/or property if there are no individuals willing or able to serve as guardian.

• Assessment and Planning: We will determine the necessity of guardianship and refer you to attorneys who are well-versed in Florida's guardianship laws, ensuring that all processes are carried out correctly and ethically. Assessment of the individual for testamentary capacity is also available.

• Guardianship Initiation: We collaborate with attorneys (yours or ours) on the preparation and filing of guardianship petitions. Interface with family members to explain the process is strongly advised to avoid conflict. Advocacy with court personnel for the client’s best interests and testimony at hearings, when advised, is always our goal.

• Guardian of the Person: In conjunction with our Care Management Services we can provide personal care and support, ensuring the physical and emotional well-being of the individual under guardianship On-site development and/or review of guardianship plans as well as guidance on placement options and assistance with the actual transition to the new environment is available.

• Guardian of the Property: Our depth of experience is available to you while locating and marshalling assets for your ward. MonarchCare can also provide expertise as to what local financial institutions work well with guardians. As the guardian, MonarchCare diligently manages assets and finances, safeguarding the individual's estate while maximizing public benefits. We maintain meticulous records, have gone through numerous court audits successfully and are intimately knowledgeable about Florida guardianship rules and laws.

• Annual Reporting and Compliance: As the guardian we prepare all necessary annual reporting and compliance obligations, saving the client legal expenses. We can either guide private and family guardians through the accounting and reporting process or prepare the reports for the guardian to ensure documentation meets or exceeds the courts’ standards. We can also advise you of the best way to obtain authorization as needed, receive reimbursements when appropriate and avoid fines or penalties. Because guardianship documents are public records, we endeavor to maintain our wards’ privacy while advocating for their best interests.
